Terms of Use

Welcome to Aube. These Terms of Use ("Terms") govern your use of the Aube mobile application ("App") operated by 100-8 Studio ("we", "us", or "our").

By downloading, accessing, or using Aube, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 18 years old to use Aube. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Account Registration

2.1 Account Creation

To use Aube, you must create an account using Sign In with Apple or Sign In with Google. You agree to provide accurate and complete information during registration.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

2.3 Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms.

3. Domains

3.1 Domain Claiming and Purchase

• Each user may claim one free domain
• Additional domains may be purchased through Apple In-App Purchase
• Domain purchases are one-time, non-refundable transactions processed by Apple

3.2 Domain Ownership

• Domains are associated with your account and are non-transferable except through the in-app transfer feature
• We reserve the right to reclaim inactive domains or domains that violate these Terms
• Domain names must not infringe on trademarks or intellectual property rights

3.3 Domain Content

You are solely responsible for the content you publish on your domains. You retain ownership of your content but grant us a license to display it on the App and aube.run.

4. Acceptable Use

You agree NOT to use Aube to:

• Post illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
• Impersonate any person or entity
• Infringe on intellectual property rights of others
• Distribute spam, malware, or malicious content
• Harass, bully, or intimidate other users
• Collect personal information about other users without consent
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the App or its systems

5. Content Moderation

We reserve the right to:

• Review, monitor, and moderate all content on the App
• Remove any content that violates these Terms without prior notice
• Suspend or terminate accounts that repeatedly violate these Terms
• Report illegal content to appropriate authorities

6. Messaging

6.1 Contact System

You may add contacts using their PIN code. Only users who have mutually added each other can exchange messages.

6.2 Message Content

You are responsible for the content of your messages. Messages that violate our Acceptable Use policy may result in account suspension or termination.

7. Purchases and Payments

7.1 In-App Purchases

Domain purchases are processed through Apple In-App Purchase. All transactions are subject to Apple's terms and conditions.

7.2 Refunds

All purchases are final. Refund requests must be directed to Apple in accordance with their refund policy.

7.3 Pricing

We reserve the right to change pricing at any time. Price changes will not affect previously completed purchases.

8. Intellectual Property

8.1 Our Property

The App, including its design, features, and functionality, is owned by 100-8 Studio and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

8.2 Your Content

You retain ownership of the content you create. By posting content on Aube, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the App.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 100-8 STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless 100-8 Studio from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
